Airplanes, public and private buses, trains, elevators, taxis, street cars and other vehicles that carry passengers for money are have to follow a different set of rules.  Texas courts have defined common carriers as those in the business of carrying passengers and goods who hold themselves out for hire by the public.  (Mount Pleasant Indep. Sch. Dist. v. Lindburg, 766 S.W.2d 208, 213 Tex.1989).  Texas courts require a higher standard of care for common carriers to promote the public safety and convenience.  Common carriers are held to a higher standard of care when transporting passengers.  The standard of care is defined as  "that degree of care that would be exercised by a very cautious and prudent person under the same or similar circumstances."  



What Can Cause Bus Accidents - Factors Include Negligence Of Bus Companies Or Bus Drivers


Bus accidents can be caused by many factors.  Bus accidents can be caused by negligence of the bus companies or the negligence of the driver.  Bus companies could be negligent in failing to properly maintain the buses such as failing to timely replace tires or brakes and in failing to hire qualified drivers.  Bus companies also can fail to comply with laws and regulations.  Bus companies may be negligent in hiring drivers without proper qualifications or in failing to properly train them.  Drivers themselves may be negligent in causing an accident as well by driving while intoxicated, or while being sleep deprived or fatigued, or by failing to maintain a proper lookout while driving, or even speeding.



Types Of Injuries That Can Occur


Injuries from a bus accident can be pretty traumatic.  A person could fall while boarding, or walking in, the bus.  Injuries from the fall can range from the minor, such as bruises, to broken bones and even death.  The bus driver can lose control or be distracted and run into other people, vehicles, or property.  The person injured in a bus accident can lose wages from being unable to work and incur medical bills and sustain injuries that effect them for the rest of their life.



What Are Some Of The Common Bus Systems In Texas


The “Greyhound” bus system runs nationally, and they must abide by the common carrier doctrine.  Your city bus must also follow the common carrier doctrine.  The Dallas Area Rapid Transit, also called “DART”, system serves Dallas, Texas.  Fort Worth Transportation Authority, also called “FWTA” or just called “The T”, serves Fort Worth, Texas.  The Capital Metropolitan Transportation Authority, or “Capital Metro”, or just “METRO” runs throughout Austin, Texas.  Metropolitan Transit Authority of Harris, or just “METRO”, serves Houston, Texas.  The VIA Metropolitan Transit, or just “VIA”, is the bus system in San Antonio, Texas.  Though the bus systems have different names, they must all follow the same rules.



Rules Of Riding The Bus And Bus Etiquette


When riding the bus, riders should follow some basic rules so that they, or others, don’t get hurt.  Pay the right fare and always be curtious to the driver and your fellow passengers.  Many bus systems cannot give you change.  Respect other passenger’s privacy. No open alcoholic beverages.  Follow these basic rules so that you, and others, can stay safe.
